The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us immediately at hello@kiidcoffee.com.
You represent and warrant that all information you provide is accurate, current, and complete, and that your use of the Services complies with all applicable laws.
2. CUSTOMER ACCOUNTS
You may create an account to place orders, manage subscriptions, and track shipments. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@kiidcoffee.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, contain inaccurate information, or have been inactive for extended periods.
3. PRODUCTS AND AVAILABILITY
We offer coffee and related products through the Services. We make reasonable efforts to display products accurately, including colors, packaging, origin, roast levels, and tasting notes. However, your screen may not display colors accurately, and product specifications may vary slightly between batches. All products are subject to availability and may be discontinued or substituted at our discretion.
We reserve the right to limit quantities, refuse or cancel orders, and correct pricing or product errors at any time, including after an order is placed.
4. ORDERS, PRICING, AND PAYMENT
Pricing. All prices are listed in U.S. Dollars (USD) and exclude applicable taxes and shipping unless otherwise stated. Prices may change without notice. We are not responsible for typographical or pricing errors and reserve the right to cancel orders affected by such errors, even after payment authorization.
Payment Methods. We accept payment methods as displayed at checkout, which may include Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, Shop Pay, and PayPal. Available payment methods may change from time to time. By providing payment information, you represent that you are authorized to use the payment method and authorize us (and our payment processor) to charge the full amount of your order, including taxes and shipping.
Taxes. Sales tax will be calculated and added at checkout based on your shipping address and applicable law.
Order Acceptance. Receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to verify, limit, or refuse any order in our sole discretion, including for suspected fraud, resale, or violation of these Terms.
5. SUBSCRIPTIONS AND AUTO-RENEWAL
IMPORTANT β PLEASE READ CAREFULLY. THIS SECTION CONTAINS AUTO-RENEWAL TERMS.
If you sign up for a subscription product (a "Subscription"), you authorize Kiid LLC to charge the payment method on file on a recurring basis until you cancel.
Subscription Terms:
- Frequency. You select your delivery frequency at signup from the options offered. You may change frequency in your account settings.
- Recurring Charges. Your payment method will be automatically charged at the then-current price for each delivery, plus applicable taxes and shipping, until you cancel.
- Price Changes. We will notify you by email at least 30 days before any price increase to your Subscription. Continued use after the notice period constitutes acceptance.
How to Cancel. You may cancel your Subscription at any time, with no cancellation fee, by:
- Logging into your account at kiidcoffee.com and selecting "Cancel Subscription," OR
- Emailing us at hello@kiidcoffee.com with your name and order number, OR
- Calling us at (678) 301-4225 during business hours.
Cancellation will take effect before the next billing cycle if received at least 48 hours before the next scheduled charge. Charges already processed are not refundable except as required by law or our Returns and Refunds policy.
California Subscribers. Consistent with California Business and Professions Code §§ 17600β17606, we will (i) present auto-renewal terms in a clear and conspicuous manner before you subscribe, (ii) obtain your affirmative consent to the auto-renewal, (iii) send an acknowledgment of the Subscription with cancellation instructions, and (iv) provide an online cancellation method that does not require contacting customer service.
6. SHIPPING AND DELIVERY
We ship to addresses within the United States only. We do not currently ship internationally. Shipping costs and estimated delivery times are calculated at checkout. Title and risk of loss pass to you upon our delivery to the carrier.
We are not responsible for carrier delays, lost or stolen packages after delivery confirmation, or incorrect shipping information you provide. If a package is lost or arrives damaged, contact us at hello@kiidcoffee.com within 7 days of the expected delivery date and we will work with you on a resolution, which may include filing a claim with the carrier.
7. RETURNS AND REFUNDS
Because coffee is a perishable product, we generally do not accept returns of opened bags. However, we stand behind every order:
- Damaged, defective, or incorrect orders: Contact us within 30 days of delivery for a replacement or refund.
- Quality issues: If you are not satisfied with the freshness or quality of your coffee, contact us within 30 days and we will make it right.
- Refund method: Approved refunds are issued to the original payment method. Refunds may take 5β10 business days to appear on your statement, depending on your bank or card issuer.
For Subscription orders, see Section 5 for cancellation terms.
8. PROMOTIONS, DISCOUNTS, AND PROMO CODES
Promotional codes and offers are subject to terms stated at the time of the promotion. Unless otherwise stated, codes (i) cannot be combined with other offers, (ii) have no cash value, (iii) are non-transferable, (iv) expire on the date stated, and (v) may be canceled or modified by us at any time. We reserve the right to refuse or cancel orders that misuse, abuse, or fraudulently apply promotional codes.

13. THIRD-PARTY LINKS AND CONTENT
The Services may contain links to third-party websites, apps, or content that are not owned or controlled by us. We do not endorse and are not responsible for third-party sites or content. Your interactions with third parties are governed by their terms and policies.

Nothing in these Terms β including any disclaimers, limitations of liability, or "as-is" provisions in Sections 18 and 19 β limits, replaces, or waives the commitments described in our Accessibility Statement or any obligations we may have under the Americans with Disabilities Act, applicable state accessibility laws, or comparable laws.
If you encounter an accessibility barrier on the Services, please contact us at accessibility@kiidcoffee.com and we will respond in accordance with the timeframes set forth in our Accessibility Statement.

17. TERMINATION

Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Miscellaneous) will survive.
18. DISCLAIMERS
THE SERVICES AND ALL CONTENT, PRODUCTS, AND MATERIALS PROVIDED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, AND WE DISCLAIM RESPONSIBILITY FOR USER CONTENT AND THIRD-PARTY CONTENT.
This Section does not limit, replace, or waive Kiid LLC's accessibility commitments described in Section 15 and our Accessibility Statement. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply only to the maximum extent permitted by law.
19. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIID LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
20. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Kiid LLC, its officers, directors, employees, and agents from any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) your User Content. We reserve the right to assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with our defense.
21. MODIFICATIONS TO THE SERVICES AND TERMS
We may modify these Terms at any time. If we make material changes, we will notify you by (a) updating the "Last Updated" date above, and (b) providing notice through the Services or by email at least 30 days before the changes take effect, where reasonably practicable. Your continued use of the Services after the effective date of the changes constitutes acceptance.
We may also modify, suspend, or discontinue any part of the Services at any time without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuance.
22. GOVERNING LAW AND VENUE
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Subject to Section 23 (Arbitration), the exclusive venue for any dispute that proceeds in court will be the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
23. DISPUTE RESOLUTION AND BINDING ARBITRATION
PLEASE READ CAREFULLY. THIS SECTION REQUIRES YOU TO ARBITRATE DISPUTES WITH KIID LLC AND LIMITS THE WAY YOU CAN SEEK RELIEF.
Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by emailing us at hello@kiidcoffee.com with a description of the dispute and the relief you seek. We will try to resolve the dispute within 60 days of receiving your notice.
Binding Arbitration. If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not in court, except as provided below.
- The arbitration will be conducted in Fulton County, Georgia, or remotely if the parties agree, or in the county where you reside if you so elect under the AAA Consumer Rules.
- The arbitrator's decision is final and binding, and judgment may be entered in any court of competent jurisdiction.
- We will pay arbitration filing fees if your claim is for less than $10,000, except where the arbitrator finds the claim frivolous.
Exceptions. Either party may bring an individual action in small claims court, and either party may seek injunctive or equitable relief in court to protect intellectual property rights.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to hello@kiidcoffee.com within 30 days of first accepting these Terms. Your notice must include your name, address, email, and a clear statement that you wish to opt out. Opting out will not affect any other provision of these Terms.
24. CLASS ACTION WAIVER
YOU AND KIID LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this Class Action Waiver is found unenforceable, the entire Section 23 (Arbitration) is null and void, but the rest of these Terms remain in effect.
25. CALIFORNIA RESIDENTS
If you are a California resident, the following additional rights apply.
Your CCPA/CPRA Rights. Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, you have the right to:
- Know what personal information we collect, use, disclose, and sell or share;
- Request deletion of your personal information;
- Correct inaccurate personal information;
- Opt out of the sale or sharing of personal information (we do not sell personal information for money, but certain advertising practices may qualify as "sharing" under the law);
- Limit the use and disclosure of sensitive personal information;
- Non-discrimination for exercising your rights.
To exercise any of these rights, please see our Privacy Policy or contact us at hello@kiidcoffee.com. You may also designate an authorized agent to make a request on your behalf.

26. ELECTRONIC COMMUNICATIONS AND SIGNATURES
By using the Services, you consent to receive communications from us electronically (email, in-account notifications, SMS where opted in). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You agree to the use of electronic signatures, contracts, and records under the Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA).
27. FORCE MAJEURE
We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, epidemics, pandemics, supply chain disruptions, internet or utility outages, or carrier failures.
28. MISCELLANEOUS
Entire Agreement. These Terms, together with our Privacy Policy, Accessibility Statement, and any other policies referenced, constitute the entire agreement between you and Kiid LLC regarding the Services and supersede prior agreements.
Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms freely.
No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights.
Headings. Section headings are for convenience only and do not affect interpretation.
